THIS FULLY BEFORE SIGNING THE BOOKING FORM
Booking Terms
The booking form must be completed and signed by the Party Leader (the client) who must be over 21 years of age. The signing of the booking form shall be deemed to be a contract between the Owners and the client and constitute the acceptance of the booking and payment procedure terms and conditions and shall be a warranty by the person so signing that they have the authority to act on behalf of the persons named on the booking form including any substitutions or additions by any subsequent agreed amendments to the booking. The procedures and conditions will still apply even if for any reason the booking form has not been completed by the client, e.g. In the case of a late booking requested by telephone which necessitates immediate commitment. The booking is not accepted until the completed and signed booking form together with the appropriate deposit has been received and the acknowledgement receipt has been issued. If the booking is not accepted for any reason the deposit will be refunded in full. Amendments to, or cancellation of a booking by the client will be subject to the provision of the Cancellation sections of these terms and conditions. The accommodation cannot be shared assigned or sublet and only persons named on the booking form are permitted to stay in the property (by Florida State Law). Persons, children under the age of 18 years are not acceptable unless accompanied by a parent or parents or a responsible adult (over 21). Pets and Smoking are not allowed. Any infringements of these conditions may result in the bond being withheld.
Payment
The person who signs the booking form is responsible for all payments in respect of the booking. Reservations will be confirmed upon return of the Booking Form along with payment of a deposit of £100/US$180 per week (or part of). This should be sent to us within 7 days of any initial telephone booking or your option will be automatically released. The balance plus appropriate security bond is payable to us no later than 10 weeks prior to the commencement of rental. Should full payment not reach us by this time, we reserve the right to cancel the booking and you will be liable to pay cancellation charges set on the scale below, see "Cancellation by the Client".
The Security Bond
Please advise the management company on arrival in the unlikely event of any faults. The client is solely responsible for any damages or breakages that may be caused to the property or to its contents and also for any loss of items in the inventory during their stay or indeed any breaches of the rental agreement. Therefore a £200/US$360 (per booking) refundable security bond payable with the final balance, will be held against such an eventuality. The villa is inspected both before and at the end of each occupation and upon confirmation that all is in order, this deposit will be refunded in full. Since it is not possible to check the accommodation before departure, the security bond will be reimbursed as soon as possible after return. Charges for damages, losses or any maintenance or repairs to equipment, amenities, fixtures necessitated by misuse will be at the discretion of the Owners and will be deducted from the security bond. ie guests who leave doors and or windows open, resulting in an excessively high energy bill may forfeit all or part of their security deposit. In the event of any damage or loss which is assessed to be in excess of the security bond, the client will be held responsible for full reimbursement of the outstanding amount within 14 days of your return. If this amount of money is not received within 14 days, these terms and conditions will constitute the notice required before action when applying to the appropriate County Court. It would be appreciated if the property is left in a clean and tidy condition at the end of the rental period. If the villa is left in an excessively dirty state, we have no choice but to charge an extra US$250.00 for a spring clean.
Amendments
The effective date of any amendment is the date on which details of the proposal amendment are received in writing. Whenever possible any amendment to the booking requested after the booking has been confirmed, will be accommodated dependant on the nature of the amendment additional costs may be incurred.
Cancellation by the Client
Any cancellation by the client must be notified in writing or e-mail directly to the Owners. Cancellation by telephone will not be accepted. In the event of cancellation by the client, the following charges will apply.
Anytime after acknowledgement receipt has been issued - Loss of deposit
60 - 90 days before arrival - 50% of total price (Less deposit already received)
Within 60 days - 100% of price (Less deposit already received)
Cancellation by the Owners
In the unlikely event that circumstances beyond our control necessitate cancellation of the booking. We will refund any moneys paid by the client, without interest, compensation or sub sequential loss of any kind. We will endeavour to find alternative acceptable accommodation through our contacts.
Price Guarantee & Rental Charges
The rental price for the villa is fully guaranteed when the deposit has been paid and the acknowledgement receipt has been issued.
The villa rental charges and the items included are as agreed by the client and the owners at the booking procedure stage.
The Rental Period
Reservations normally run from Saturday to Saturday and are for a minimum of 7 nights (other than by arrangement)
The Villa is available for occupation from 4.00 p.m. (local time) on the day of arrival until 10.00 a.m. on the day of departure. Vacating after 10.00 a.m. May incur charges equivalent to one nights occupation cost.
Unacceptable Behaviour
The owners and the Management Company reserve the right to instruct all guests to vacate the property, without notice, in the very unlikely event that there should be any incidents deemed to be act(s) of unacceptable behaviour, misconduct, lack of consideration and attention, or malicious intent. The owner and the management company will not be liable for any loss to any guests as a result of this unfortunate action.
International Travel Requirements
Clients are personally responsible for the provision of adequate Travel/Health Insurance and International Travel Documentation. Cancellation by clients due to incorrect documentation will be charged the relevant cancellation fees.
Force Majeure
The Owners and their representatives accept no responsibility whatsoever and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural disasters, fire, flood, adverse weather conditions, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers, or any other events beyond the Owners control.
Complaints
In the unlikely event of any complaints during your stay, please contact the Management Company immediately. Their contact details will be in the property. If you have any further complaints please contact the owner in writing within 14 days of returning from your holiday. If, as requested, the problem was not reported to the Management Company during your stay the owner cannot accept any responsibility.
Brochure Description
Whilst all information supplied in the brochure and or website is deemed to be correct and to the best of our knowledge, it is understood that the information supplied is for guidance purposes only and does not form part of any contract.
House Rules
All doors and windows shall be closed and secured whenever the guests are not in the property. We ask that all external doors and windows are not left open as the air-conditioning system could freeze up. Guests who leave doors and or windows open, resulting in an excessively high energy bill may forfeit all or part of their security deposit. Please remove all food stuffs and place in trash. Please ensure the trash is put out for collection the night before a collection day (See renters guide for trash collection days). Please do not move any of the furniture. Do not park on the road.
Telephone
The property is provided with a telephone that provides a free incoming call service as well as free use for local (863) and emergency (dial 911) calls only. All other calls, including international and long-distance calls are to be paid for by the guest, through the use of a pre-paid phone card, available at local stores or gas stations. If the owners receive any additional phone charges incurred during the rental period. These charges will be deducted from the security deposit.
WC/Toilet
Toilet blockage can occur from time to time due to guests disposing of sanitary towels or the use of excessive toilet tissue usually by children. If this happens the toilet can be unblocked with use of the rubber plunger supplied. If the management company is called out to unblock the toilet. They will charge the guest US$60.
Limitation of Liability
Although every effort is made to ensure that the villa is in perfect condition, the Owners cannot accept responsibility for any claims, accidents, damage, or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of howsoever they have occurred, nor can liability be accepted for injury as a result of the use of the swimming pool/spa, howsoever caused. Guests are specifically advised not to allow unsupervised children access to the staircase and balcony area or the pool/spa and surrounding area. Glass is not permitted in the screened area. The pool alarms must be kept on at all times. It is an offence under Florida law to disable these alarms.
Pool /Spa
Pool temperatures are
dependant on local weather conditions.
Alarm/Entry System
The Villa has a front door
Keypad Entry Lock. Guests will be given the combination prior to arrival.
On exiting the Villa the door is locked by pressing the “Lock” button,
guests must ensure that the door is locked properly by trying the handle.
The villa is equipped with an alarm
system with detectors on all external doors and a motion sensor in the
downstairs lounge. Guests will be given the combination prior to arrival (Note:
this number will be different from the Door combination).
The alarm panel is located through the
front door, straight ahead towards the kitchen and on the left hand side next to
the telephone.
Upon Entry:
The Alarm MUST be disarmed by entering
the given 4 digit code on the panel. An audible response “Disarmed” will be
given by the panel.
Upon Exit:
Note: You do not need to enter the
code to arm the system.
Pool Alarm:
The Patio Door and the Door from the
Master Bedroom are both permanently alarmed as per Florida Law. The Alarm will
beep if either door is opened and will continue to beep until the door is
closed.
Any tampering with or damage to
the Alarm System will result in the loss of Security Bond.
Law
This contract is subject to and shall be construed in accordance with Florida State Law and the Laws of the United Kingdom and the parties hereby submit to the exclusive jurisdiction of the United Kingdom Courts.
